Terms of service.

Please read these terms carefully before using terce.io. By accessing or using the service, you agree to be bound by these terms.

1. The service

Terce provides a non-custodial cryptocurrency exchange service. We facilitate the conversion of one cryptocurrency to another by routing transactions through established liquidity infrastructure. We do not take custody of funds at any point. We do not operate a wallet service, a brokerage, or a financial institution. We do not hold balances on behalf of users.

2. Eligibility

You must be at least 18 years of age to use this service. By using Terce, you represent that you are at least 18 years old. You must not use the service from a jurisdiction where doing so would be unlawful. Determining whether your use is lawful in your jurisdiction is your responsibility.

3. Prohibited use

You may not use Terce to exchange proceeds of criminal activity, to circumvent lawful financial sanctions, to fund terrorism or other prohibited activities, or in violation of any applicable law. We reserve the right to refuse service or freeze processing in connection with transactions we reasonably believe to be associated with prohibited activity.

4. Exchange process and risk

Cryptocurrency exchange carries financial risk. Exchange rates are volatile and the rate you receive may differ from the rate displayed at initiation. Network fees, confirmation times, and market conditions affect the final amount received. By initiating an exchange, you accept these risks.

Exchanges are irreversible once funds have been sent to the deposit address and confirmed on-chain. Verify all destination addresses and asset selections before sending funds. We are not responsible for losses resulting from user error including incorrect destination addresses, incorrect asset selection, or incorrect network selection.

5. No custody, no liability for chain events

Because Terce does not take custody of funds, we are not liable for losses resulting from blockchain network failures, protocol changes, hard forks, theft from wallets, or other events occurring outside our systems. Our responsibility is limited to routing the exchange transaction as specified.

6. Third-party infrastructure

Terce uses third-party infrastructure to source rates and process exchanges. We are not liable for failures, delays, or errors attributable to third-party providers. We will make reasonable efforts to resolve such issues but cannot guarantee outcomes dependent on third-party systems.

7. Limitation of liability

To the maximum extent permitted by applicable law, Terce and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of funds, revenue, or data, arising out of or in connection with use of the service, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising from use of the service shall not exceed the equivalent in USD of the exchange fee earned on the specific transaction giving rise to the claim.

8. No warranties

The service is provided "as is" without warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or free from harmful components. We do not warrant that exchange rates will be accurate at any particular time.

9. Intellectual property

All content, design, and software on terce.io is the property of the Terce operator and is protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works without permission.

10. Changes to terms

We may update these terms at any time. Material changes will be noted by updating the "Last updated" date. Continued use of the service after changes take effect constitutes acceptance of the revised terms.

11. Governing law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the appropriate courts of competent jurisdiction in the United States.

12. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
